Colorado enacts ‘red flag’ law to seize guns from those deemed dangerous, prompting backlash

This sucks! As I understand it, nearly anyone can attest to a made up fact that a gun owner is dangerous and his guns will be taken away in violation of the second amendment. The gun owner will have to prove to the state he is not dangerous.

Damn them, I have my compound and re-curve bows and I can still use them effectively.

I’m fairly sure that criminals will turn in other criminals with this law in place. Yea right, keep dreaming.

  1. They’ve reversed the traditional evidentiary burdens. The term “preponderance” has no relevance to ex parte (defendant not appearing) proceedings.

    Historically, an ex parte proceeding has a “clear and convincing evidence” burden. Then, the defendant gets a hearing where he can prevail by a mere preponderance.

    All of these kinds of laws also run afoul of another traditional requirement of due process, that there be no reasonable less burdensome alternatives. Here, a reasonable alternative is an immediate hearing. If the police come to G.D.’s house to serve the order, he should be able to say: “Just take me to the court house so I can challenge this.”
