  4. Physics teaches us that path is irrelevant to start versus finish.  If you drop a 10 lb sand bag 10 feet you get out 100 ft-lbs of energy.  Whether it drops straight down, along a brachistochrone, powering a rollercoaster, or bouncing on a trampoline, it remains 100 ft-lbs net.

    DemSoc, wokesters, and political corruption instruct us that feelings, goals, rights, dialectic, and acts can change that 100 ft-lbs net to anything you like.  Reality is a Potemkin village with Lysenko gardeners.  You can plant beets and get out prime rib roasts.

    Mayor de Blasio is a “local authority” with clear enforcement power and has at his disposal one of the largest municipal police departments in the world, (Dkt. No. 1, Attach. 1 at 127), and has also actively encouraged participation in protests and openly discouraged religious gatherings and threatened religious worshipers as set forth above. The City’s argument that temporary selective enforcement of the challenged laws with respect to mass race protests is a matter of public safety based on the rationale of Sisolak, 2020 U.S. Dist. LEXIS 103234, would perhaps be legitimate but for Mayor de Blasio’s simultaneous pro-protest/anti-religious gathering messages, which clearly undermine the legitimacy of the proffered reason for what seems to be a clear exemption, no matter the reason. Governor Cuomo and Mayor de Blasio could have just as easily discouraged protests, short of condemning their message, in the name of public health and exercised discretion to suspend enforcement for public safety reasons instead of encouraging what they knew was a flagrant disregard of the outdoor limits and social distancing rules. They could have also been silent. But by acting as they did, Governor Cuomo and Mayor de Blasio sent a clear message that mass protests are deserving of preferential treatment.

    Sisolak is the Nevada case. There also were allegations of favoritism for the rioters. The asserted public safety exception is dubious. Had the KKK been rioting would the officials have failed to act? If the BLM protesters behaved peacefully, would they have been arrested? Thus even this judge erred in asserting: “…Governor Cuomo and Mayor de Blasio sent a clear message that mass protests are deserving of preferential treatment.” Only a particular mass protest.

  6. @ctlaw, thank you for so faithfully providing this information that I would never in a million years obtain otherwise.

    So this is a Federal judge at some courtroom in Albany? And his name is Sharpe? “Gary L. Sharpe, US District Judge?” Is this the “US Northern District Court, Albany Divisional Office?”  The taxonomy of US Courts is totally opaque to me.

    Correct. Larger states have several different federal districts. NY has 4. The Northern District includes Albany and one of its several courthouses/divisions is in Albany.
